1. Definitions and Scope

Welcome to SIQ PETRA. The platform is operated by Siq Petra for Marketing and E-Commerce LLC, a company registered in the Hashemite Kingdom of Jordan under National Establishment No. 200212988 and Registration No. 82058, referred to in these Terms as “SIQ PETRA”, the “Platform”, “we”, “us”, or “our”.

These Terms govern the use of the website and related digital services, account creation, browsing products, placing orders, payments, shipping, returns, communications with suppliers, and any other services made available through the Platform.

Use of the website, creation of an account, or completion of a purchase constitutes acceptance of these Terms and the policies incorporated into them, to the extent permitted by applicable law. Nothing in these Terms shall be interpreted as a waiver of any mandatory consumer right granted by applicable legislation.

2. Nature of SIQ PETRA and the Online Marketplace

SIQ PETRA is an e-commerce platform for displaying, marketing, and selling products, including products offered by approved independent suppliers, artisans, and brands. Depending on the product, order, invoice, and transaction structure, SIQ PETRA may act as a seller, supplier, transaction facilitator, or provider of online marketplace services.

Describing SIQ PETRA as a “platform” or “online marketplace” is not intended to exclude any liability imposed on it by law. At the same time, each supplier remains contractually responsible to SIQ PETRA for the accuracy of information, the product, source, quality, licences, intellectual property rights, and all obligations falling within that supplier’s scope, without prejudice to the customer’s statutory rights.

3. Legal Capacity

Purchases must be made by a person who has the legal capacity to contract, or through a parent, guardian, trustee, or duly authorised representative where required. The Platform and payment methods must not be used fraudulently or without proper authorisation.

4. Accounts and User Information

When creating an account, the user must provide accurate and up-to-date information, keep login credentials confidential, and notify SIQ PETRA immediately if unauthorised use of the account is suspected.

SIQ PETRA may suspend an account or request identity verification where there are reasonable indicators of fraud, misuse, or a threat to Platform security, subject to applicable law and the Privacy Policy.

5. Product Information

SIQ PETRA aims to display product information clearly and accurately. Depending on the nature of the product, this may include the product name, description, images, price, country of origin, materials or ingredients, weight or size, instructions for use, warnings, warranty information, and supplier identity.

Each supplier warrants to SIQ PETRA that the information it provides is accurate and complete. No product may be described as Jordanian, authentic, handcrafted, local, natural, organic, therapeutic, or by any similar claim unless that claim is capable of substantiation and legally permitted.

Colours may vary slightly due to screen settings and lighting. This does not justify any material difference between the product as advertised and the product delivered.

6. Prices, Taxes, and Charges

Prices are displayed in the currency shown on the website. Where applicable, the final price, shipping charges, taxes, and other additional charges that are known and calculable will be displayed before the order is confirmed.

If there is an obvious technical or typographical pricing error that leaves no reasonable doubt that the displayed price is incorrect, SIQ PETRA may place the order on hold and verify the price before final acceptance. If payment has already been collected and the order cannot be fulfilled because of such an error, the amount due to the customer will be refunded.

7. Order Submission and Acceptance

Adding a product to the cart does not constitute final reservation of that product. An order is considered received when successfully submitted, but electronic receipt does not necessarily constitute final acceptance where fulfilment requires verification of stock, payment, address, or legal restrictions.

An order is considered confirmed when SIQ PETRA sends final confirmation or begins fulfilment, depending on the Platform’s operating process. The customer will receive or retain an electronic record of the order confirmation and its essential details.

8. Rejection or Cancellation by SIQ PETRA

SIQ PETRA may reject or cancel an order for a legitimate reason, including stock unavailability, legal or logistical restrictions, inability to verify payment, reasonable suspicion of fraud, or an obvious material error in product information or pricing.

If SIQ PETRA cancels an order after payment has been collected and there is no lawful or contractual basis to retain any amount, the amount due will be refunded in accordance with the applicable refund process.

9. Payment

Payments are made using the payment methods available at checkout. Payment may be processed through approved independent banks or payment service providers and may also be subject to their verification and security procedures.

Customers must not send full card details, PINs, passwords, or card verification codes to SIQ PETRA by email or chat. If an unknown or duplicate charge appears, the customer should contact us promptly and provide the order number and other non-sensitive information needed for verification.

10. Fraud Prevention and Misuse

SIQ PETRA may conduct reasonable checks on orders and transactions to protect customers, the Platform, and payment service providers against fraud. This may require temporary suspension of an order or a request for additional verification information to the extent necessary and permitted by law.

11. Shipping and Delivery

Shipping is governed by the published Shipping & Delivery Policy. Displayed delivery times are estimates unless expressly stated otherwise, without prejudice to any legal obligation to deliver within the agreed or customary period.

The customer must provide a correct delivery address and an active contact number. To the extent permitted by law, the customer may be responsible for actual and reasonable costs directly resulting from an incorrect address or unjustified refusal to accept delivery.

12. Returns, Exchanges, and Refunds

Returns, exchanges, and refunds are governed by the Returns, Exchanges & Refunds Policy. That policy does not restrict any customer right relating to defective goods, products that do not match their description or specifications, or products that fail to meet applicable legal requirements.

13. Suppliers and Sellers

Suppliers are contractually required to SIQ PETRA to ensure the legality, authenticity, safety, and accuracy of products and product information, to hold all necessary rights and licences, and to comply with the requirements of relevant regulatory authorities.

Subject to the supplier agreement and applicable law, SIQ PETRA may seek recovery from a supplier for amounts, costs, losses, or customer claims directly arising from that supplier’s breach, without limiting any independent legal responsibility of SIQ PETRA.

14. Intellectual Property

The SIQ PETRA name, logo, visual identity, website design, original texts, photographs, marketing materials, and databases are protected under applicable laws and may not be commercially exploited without written permission.

Third-party trademarks and supplier materials remain the property of their respective owners. Each supplier warrants that it holds the rights necessary to authorise SIQ PETRA to use such materials for displaying and marketing products.

15. User-Generated Content

Where the Platform allows reviews, comments, or images, user content must not contain abuse, defamation, deception, or infringement of third-party rights. The user grants SIQ PETRA a non-exclusive licence to use such content to the extent necessary to display it, operate the service, and promote the Platform, subject to the Privacy Policy.

16. Prohibited Use

Users must not impersonate others, use unauthorised payment methods, attempt to hack or disrupt the website, transmit malicious software, scrape data in a way that harms the Platform, manipulate reviews or orders, infringe intellectual property rights, or use the Platform in any unlawful manner.

17. Service Availability

SIQ PETRA uses reasonable efforts to maintain the availability and security of the website. Services may, however, be affected by maintenance, communications failures, third-party service interruptions, or circumstances beyond reasonable control. SIQ PETRA does not guarantee continuous, uninterrupted operation at all times.

18. Liability and Limitations

SIQ PETRA is responsible for its acts and obligations to the extent required by law. To the extent permitted by law, SIQ PETRA is not liable for indirect or consequential losses that are not the direct and reasonably foreseeable result of an established breach by SIQ PETRA.

No exclusion or limitation of liability applies where prohibited by law, including in relation to fraud, intentional misconduct, or any mandatory consumer right that cannot lawfully be excluded.

19. Force Majeure

A delay or failure to perform will not constitute a breach to the extent that it results solely from an event beyond reasonable control that could not reasonably have been anticipated or its effects avoided, provided reasonable steps are taken to mitigate the impact and resume performance when possible.

20. Electronic Communications

Order confirmations, invoices, security notices, operational notifications, and service-related communications may be sent electronically to the contact details registered by the customer. Marketing communications are subject to consent and other applicable legal requirements.

21. Electronic Records

SIQ PETRA may retain electronic records of orders, consents, transactions, and communications in accordance with the Privacy Policy and legal requirements, and may use such records for order administration, dispute resolution, and proof of transactions to the extent permitted by applicable legislation.

22. Amendments to These Terms

These Terms may be updated to reflect changes in services, legislation, or operational requirements. The date of the latest update will appear on the page. Material changes will not be applied retrospectively in a manner that reduces accrued rights in a completed transaction unless required by law.

23. Severability and No Waiver

If any provision is found invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law. SIQ PETRA’s failure to exercise a right in a particular instance does not constitute a permanent waiver of that right.

24. Governing Law and Jurisdiction

These Terms are governed by the laws in force in the Hashemite Kingdom of Jordan. The competent Jordanian courts shall have jurisdiction over disputes, without prejudice to any mandatory consumer right or jurisdiction that cannot lawfully be varied by agreement.
